At FireDrum, we are aware of our responsibilities and are dedicated to protecting the privacy rights of other Internet users. We STRONGLY oppose the sending of unsolicited e-mail (spam) and have made every effort within our power to discourage and prohibit the sending of spam.
FireDrum does not allow anyone to use our products or services for the purpose of sending spam. We have and will continue to refuse business from known spammers. If a current FireDrum customer uses our products or services for the purposes of spamming anyone, their product use privileges and/or service contract will be voided without refund.
We are highly sensitive to the privacy of each of the subscribers on the lists that we host and will not make their name, address, or any other information that they have provided us available to anyone without the subscriber's express permission. We require that each message sent out includes an easy way for the subscriber to remove themselves from the list and in cases where the subscriber cannot remove themselves from the list for whatever reason; our support staff will help them remove themselves from the list.
FireDrum may determine at its sole discretion whether a customer is spamming. There are a number of factors FireDrum uses to determine whether a customer is spamming, including, but not limited to: complaints sent to abuse report addresses, SpamCop reports, complaints sent to any of FireDrum's upstream providers, and evaluating a customer's mass e-mail statistics and recipient addresses. Decisions made by FireDrum personnel regarding a customer's use of FireDrum are final.
Spam is unsolicited email also known as junk mail or UCE (Unsolicited Commercial Email.) By sending email to only to those who have requested to receive it, you are following accepted permission-based email guidelines.
- Any e-mail message that is sent to a recipient who had previously signed up to receive newsletters, product information or any other type of bulk email but later opted-out by indicating to the sender that they did not want to receive additional email, then that email is spam.
- Any e-mail message that is sent to recipients that have had no prior association with the organization or did not agree to be e-mailed by the organization is spam.
- Any e-mail message that is sent to a recipient without a way for a person to opt-out or request that future mailings not be sent to them, is spam.
- Any email message that does not have a valid email address in the reply-to line is spam.
- Any email message that contains any false or misleading information is spam.
- Any email message that promotes an adult web site is spam, unless the recipient has specifically requested information from that web site.
- Any message that is sent to e-mail addresses that have been harvested off of web sites, newsgroups, or other areas of the Internet is spam.
- An e-mail message is NOT spam if the recipient in anyway requested email be sent to them from the sender or the sender's organization.
- Anytime an organization sends a bulk email message to one of its customers or members is NOT spam provided that the organization offers a way for the customer to opt-out of future mailings and that the customer did not previously opt-out.
- An e-mail message is NOT spam when sent to recipients who agreed to receive information or promotions from a partner organization (as long as there is a clear opt-out option).

| Permission Marketing Policy |
FireDrum is a powerful e-marketing tool designed for permission-based communications. Our clients use FireDrum to send email newsletters and promotions to customers/members prospects. FireDrum's policy strictly forbids the use of our service for transmission of unsolicited “bulk” or commercial email. All FireDrum customers have agreed not to use the system to send unsolicited email.
Clients use FireDrum to send email to individuals with whom they have an existing relationship or who have expressly indicated through an "opt-in" process that they want to receive the type of email communication being sent. If a customer chooses to use an "opt-in" list, they must provide FireDrum with the source of that information. Additionally, the customer will be required to indicate in the email that the recipient is receiving the mail based on the fact that they indicated an interest in receiving the type of information being sent in an "opt-in" list.
Unsubscribing from a FireDrum email.
Each email sent through the FireDrum system contains a link that allows subscribers to unsubscribe from receiving emails from the sender. Each email sent contains an easy and automated way for you to unsubscribe. You may also change your expressed interests at any time. If you wish to unsubscribe or change your interests, simply follow the instructions at the bottom of any email. If you have received an unwanted email sent by the FireDrum system, please forward a copy of the email with your comments to abuse@FireDrum.com
Our clients agree not to use our system to send unsolicited email. For any opt-in list of email addresses used in our system, clients agree to provide FireDrum with the source of the email addresses, the method used to capture the data, and verification of the consent to receive emails from such client. We also encourage our members to respect their customers’ time and attention by controlling the frequency of mailings to individual email addresses.
Our clients certify that they will not use borrowed, rented or purchased lists, email append lists, or any other list that contains email addresses captured in any other method than opt-in. The use of Opt-out lists is prohibited in our system. FireDrum retains the right to review client lists and emails to verify that clients are abiding by the privacy and permission policies set forth herein. However, our clients are ultimately responsible for compliance with our policies.
What to do if you believe you've been spammed.
If you believe you have received an unsolicited email using the FireDrum system (or what appears to be the FireDrum system), please take a moment to tell us about it. Please forward a copy of the offending email to abuse@FireDrum.com. We are strong believers in permission-based marketing and do not tolerate "spam." We will immediately investigate, and if abuse is proven, will take immediate appropriate action to eliminate abusive future mailings from the company involved.

| Why did you receive an email from our system? |
If you received an email from us, it is because one of our clients used the FireDrum software system to send you an email. Our clients certify that all email addresses used in our system are opt-in names that have given permission to the client to send them email. We promise to keep your email address secure and private and will not use it for other purposes.
| Will your information be shared, sold, or rented? |
We will never share, sell, or rent individual personal information unless ordered by a court of law. Information submitted to us is only available to employees responsible for managing this data.
FireDrum has taken an additional step for permission-based marketing by verifying opt-in procedures into our web site email collection tools used by FireDrum and many of our clients. Any time someone adds their email address using our information collection tools, they will be sent an e-mail disclosing that they are a new member and if they did not sign up they may unsubscribe immediately.
- Results. Email marketing is most effective when messages are anticipated, personal and relevant. Sending unsolicited email reduces deliverability and ROI.
- Reputation. Inappropriate use of email generates customer complaints and will damage your reputation and brand.
- Legal Environment. Permission email marketing is no longer voluntary. Recently enacted US legislation make “direct consent” the law, and permit large fines for marketers not following permission practices.
